Terms of Service
Effective date: October 30, 2026
These Terms of Service (“Terms”) govern your use of Post Launch, including the application at app.postlaunch.tech and the website at postlaunch.tech (together, the “Service”). The Service is provided by Post Launch, LLC (“Post Launch,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
If you have signed a separate written agreement with us covering the Service, that agreement controls where it conflicts with these Terms.
1. Business Use Only
The Service is intended for businesses, such as agencies, studios, and post-production companies. If you use the Service on behalf of a company or organization, you represent that you have authority to accept these Terms on its behalf, and “you” includes that organization. You must be at least 18 years old to use the Service.
2. Accounts
You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate account information and keep it up to date. Do not share accounts between individuals. Notify us promptly at the contact address below if you believe your account has been accessed without authorization.
Organization administrators may invite, manage, and remove users, and control their permissions. We are not responsible for actions an administrator takes within your organization's workspace.
3. Pricing
The Service is currently offered free of charge. We may introduce paid plans in the future. Before any charges apply to you, we will give you at least 30 days' notice, and you will not be charged unless you choose a paid plan and agree to its pricing and payment terms.
4. Your Content
Ownership. You and your organization keep all rights to the files, materials, and information you upload to or create in the Service (“Customer Content”). We do not claim ownership of Customer Content.
Permission to operate the Service. You grant us a limited permission to host, store, copy, process, transmit, and display Customer Content only as needed to provide, secure, and support the Service for you, and as described in our Privacy Policy.
Confidentiality. We treat Customer Content as confidential. We will not disclose it except to our service providers as needed to operate the Service, as you direct, or as required by law.
Security incidents. If we confirm a security incident that affects your Customer Content, we will notify your organization's administrators without undue delay, and no later than 24 hours after we confirm it, and keep them updated until it is resolved.
Your responsibilities. You represent that you have all rights and permissions needed to upload and share Customer Content through the Service, including any rights required by your clients, studios, or other rights holders. You are responsible for deciding who in your workspace can access Customer Content.
Keep your own copies. The Service is a workflow and collaboration tool, not a long-term archive. You are responsible for keeping your own backups of Customer Content, including master files and deliverables.
5. Acceptable Use
You agree not to:
- upload or share content you do not have the right to use, or that infringes anyone's intellectual property or privacy rights;
- use the Service for any unlawful purpose;
- upload viruses, malware, or other harmful code;
- attempt to access accounts, workspaces, or data that are not yours;
- probe, scan, or test the Service's security, or bypass any security or access controls;
- interfere with or place an unreasonable load on the Service;
- copy, reverse engineer, or attempt to extract the Service's source code, except where the law expressly allows it;
- resell, sublicense, or provide the Service to third parties outside your organization, except to collaborators you invite to your workspace; or
- use the Service to build a competing product.
6. No AI Processing of Your Content
Post Launch does not use artificial intelligence or machine learning to process Customer Content, does not send Customer Content to any AI service, and does not use Customer Content to train any model. If we ever offer an AI feature, it will be optional, described in our Privacy Policy before it is available, and used only with your organization's permission.
7. Third-Party Services
The Service works with third-party services, such as Google and Microsoft sign-in and Slack notifications. Your use of those services is governed by their own terms, and we are not responsible for them.
8. Our Intellectual Property
The Service, including its software, design, and branding, belongs to us and our licensors. These Terms do not give you any rights to it beyond using the Service as permitted here. If you send us suggestions or feedback, we may use them without any obligation to you.
9. Privacy
Our Privacy Policy explains how we collect and use information. By using the Service, you agree to that policy.
10. Changes to the Service
We are continually developing the Service and may add, change, or remove features. If we make a change that materially reduces the Service's core functionality, we will try to give you reasonable advance notice.
11. Suspension and Termination
You may stop using the Service and close your account at any time by contacting us.
We may suspend or terminate your access if you materially violate these Terms, if your use poses a security risk or could harm the Service or other users, or if required by law. Where reasonable, we will notify you first and give you an opportunity to fix the problem.
We may also discontinue the Service entirely. If we do, we will give you at least 30 days' notice so you can retrieve your Customer Content.
After termination, we may delete Customer Content as described in our Privacy Policy. Sections 4 (Keep your own copies), 8, and 12 through 16 survive termination.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT CUSTOMER CONTENT WILL NEVER BE LOST.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limits do not apply to your obligations under Section 14, or to liability that cannot be limited under applicable law.
14. Indemnification
You agree to defend and indemnify Post Launch, LLC against any third-party claims, damages, and costs (including reasonable attorneys' fees) arising from your Customer Content or your violation of these Terms.
15. Governing Law and Disputes
Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
Informal resolution. If a dispute arises from these Terms or the Service, the party raising it will send the other a written notice describing the issue. Both parties will try in good faith to resolve it informally within 30 days of that notice.
Mediation. If the dispute is not resolved within those 30 days, either party may request mediation. Mediation will take place in Los Angeles County, California (or by video conference if both parties agree), before a mediator the parties choose together, or if they cannot agree, a mediator provided by JAMS. Each party will pay its own attorneys' fees, and the parties will split the mediator's fees equally. Neither party may file a lawsuit about the dispute until mediation has been attempted, or until 60 days have passed since mediation was requested, whichever comes first.
Courts. If the dispute is not resolved through mediation, it will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and both parties consent to those courts' jurisdiction.
Urgent matters. Either party may go directly to court, without first completing informal resolution or mediation, to seek an emergency order to stop unauthorized access to the Service, misuse of confidential information or Customer Content, or infringement of intellectual property rights.
16. General
- Changes to these Terms. We may update these Terms from time to time. We will post the updated version with a new effective date and notify you of material changes by email or through the Service at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
- Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service, unless you have a separate written agreement with us.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them in connection with a merger, acquisition, or sale of assets.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages at our infrastructure providers, natural disasters, or labor disputes.
